Acceptable Use Policy

This Acceptable Use Policy (“AUP”) forms part of the Terms of Service and Merchant Agreement between YOBPAY (“YOBPAY”, “we”, “us”, “our”) and any individual or entity (“Merchant”, “User”, “you”) accessing or using YOBPAY’s payment processing, financial technology, or related services (“Services”). By using the Services, you agree to comply with this AUP. Failure to comply may result in immediate account suspension, withholding of funds, termination, or reporting to regulators and law enforcement.

1. PURPOSE AND SCOPE

 1.1 This AUP sets forth categories of activities, businesses, goods, and services that are prohibited or restricted when using YOBPAY Services.
 1.2 This AUP is required under applicable laws and regulations, card network rules, banking-partner policies, and compliance standards, including AML/CTF, sanctions, fraud-prevention, and consumer-protection frameworks.
 1.3 YOBPAY reserves the right to update this AUP at any time to reflect regulatory changes, risk findings, or partner requirements.

2. GENERAL COMPLIANCE REQUIREMENTS

 2.1 User Obligations
 You agree to:
 a) use the Services only for lawful business purposes;
 b) provide complete, accurate, and current information;
 c) notify YOBPAY of any material change in business activity or ownership;
 d) comply with all applicable AML/CTF, sanctions, anti-fraud, and data-protection laws;
 e) prevent unauthorized or suspicious use of your account;
 f) cooperate with audits, monitoring, enhanced due diligence, and compliance assessments.

2.2 Prohibition on Circumvention
 You may not evade or attempt to evade this AUP, geographic restrictions, sanctions controls, or onboarding requirements.

3. PROHIBITED BUSINESSES AND ACTIVITIES

The Company does not allow businesses to engage in fraudulent, illegal, or otherwise prohibited activities through its Payment Processing Service, nor to misuse the service for unauthorized purposes. Any violation of this policy may result in immediate suspension or termination of access to the Payment Processing Service without prior notice. Businesses offering illegal or unauthorized products or services are not eligible to use the Company’s Payment Processing Service.

The Company evaluates the nature of each business using information provided by the business, publicly available sources, government records, and reliable third-party data. When a Payment Partner is involved in the flow of funds, the prohibited industries list of that Payment Partner is also considered in the assessment and classification of the business.

The following categories are strictly prohibited.

a) Products or services prohibited by applicable law or regulation
b) Controlled substances, drugs, drug paraphernalia, chemicals, online pharmacies, or sale of prescription drugs or medical devices without required licensing
c) Firearms, weapons, ammunition, military arms, firearm parts, explosives, signal jammers, or communication-interference devices
d) Money laundering, terrorism financing, tax evasion, shell banks or shell companies, unauthorized money changers, or sanctioned-list inclusions
e) Intellectual-property infringement, including counterfeit or unauthorized branded goods, stolen goods (physical, digital, or virtual), and illegal downloads of movies, music, software, or games
f) Gambling, wagering, games of chance, or gambling-related providers and transactions
g) Illegal or unlicensed investment schemes, binary options, HYIPs, pyramid, Ponzi, or deceptive MLM structures
h) Credit repair, debt collection, loan modification, or outbound telemarketing services
i) Adult entertainment, sexual services, or explicit websites and content
j) Tobacco, cigars, electronic cigarettes, nicotine, and vaping products
k) Espionage or surveillance equipment and accessories
l) Poisonous, hazardous, or restricted materials without authorization
m) Human remains or body parts
n) Pawn shops, tattoo parlours, massage parlours
o) Surrogacy services or mail-order bride services
p) Identity theft, synthetic identities, transaction laundering, deceptive practices, or sale/misuse of personal or financial data
q) Malware, hacking tools, spyware, botnets, or cyber-intrusion services
r) Selling artificial engagement such as likes, followers, or reviews
s) Products or services promoting abuse, hatred, racism, religious persecution, terrorism, violence, or offensive content
t) Unlicensed tax, accounting, or legal services
u) Prohibited industries as defined by major card schemes

4. CRYPTOCURRENCY-RELATED RESTRICTIONS (if applicable)

 4.1 Prohibited Crypto Activities
 a) privacy-enhancing or anonymity-focused cryptocurrencies;
 b) mixers, tumblers, chain-obfuscation services;
 c) unlicensed exchanges, OTC brokers, wallet providers;
 d) ICOs, token offerings, unregulated securities;
 e) illegal NFTs or IP-infringing digital assets.

4.2 Permitted with Prior Approval
 a) regulated cryptocurrency exchanges;
 b) blockchain infrastructure providers;
 c) merchants accepting crypto through approved processors.

5. SANCTIONED & NON-SUPPORTED JURISDICTIONS

 5.1 YOBPAY prohibits onboarding, transactions, or commerce involving any individual, entity, or business located in, established in, operating from, or conducting business with the following non-supported jurisdictions, including but not limited to:

Afghanistan, American Samoa, Belarus, Benin, Bosnia and Herzegovina, Botswana, Burkina Faso, Burundi, Cambodia, Cape Verde, Central African Republic, Chad, Congo, Cuba, Equatorial Guinea, Ethiopia, Fiji, Gambia, Guam, Guinea, Guatemala, Guinea-Bissau, Honduras, Iran, Iraq, Laos, Liberia, Mali, Mongolia, Myanmar, Nicaragua, Niger, North Korea, Palau, Palestine, Russia, Samoa, Senegal, Sierra Leone, Somalia, Sri Lanka, Sudan, Syria, The Republic of Burkina Faso, Tajikistan, Togolese Republic, Turkmenistan, US Virgin Islands, Ukraine/Crimea (Restrictive measures in response to the illegal annexation of Crimea and Sevastopol), Venezuela, and Yemen.

5.2 You may not use VPNs, proxies, intermediaries, or corporate structures to obscure jurisdiction or evade restrictions.

6. RESTRICTED BUSINESSES REQUIRING APPROVAL

These categories may be allowed only after enhanced due diligence and explicit written authorization:

  1. Charities, NGOs & Non-Profit Organizations
  2. Airlines, Ticketing Agencies, Online Travel Aggregators (OTAs) & DMCs
  3. Online Marketplaces
  4. Luxury Goods Merchants (e.g., gems, jewellery, silverware, premium beauty/cosmetics)
  5. Aroma, Organic & Herbal Products
  6. Beauty Products & Cosmetics
  7. Auctions
  8. Crowdfunding Platforms
  9. Cryptocurrencies, Synthetic or Non-Traditional Securities
  10. Licensed Financial Services, Regulated Fintech & Securities Brokers / Investment Providers
  11. Subscription Billing Services
  12. Digital Games, Virtual World Credits & Games of Skill (No Cash Prizes)
  13. Fantasy Sports, E-sports Gaming or Tournaments
  14. Dropshipping Businesses
  15. Private Medical Practices & Online Doctor Consultations

7. MONITORING, SUSPENSION, AND TERMINATION

 7.1 YOBPAY may monitor transactions and merchant activity at all times.
 7.2 YOBPAY may suspend or terminate accounts, freeze funds, or request documentation based on risk findings.
 7.3 YOBPAY may notify banking partners, regulators, or law-enforcement agencies where required.

8. ENFORCEMENT AND LIABILITY

 You are responsible for ensuring compliance with this AUP. You agree to indemnify YOBPAY for any losses, penalties, or claims arising from your violations.

9. AMENDMENTS

 YOBPAY may revise this AUP at any time. Continued use of the Services constitutes acceptance of updates.

Note: The lists of prohibited and high-risk/restricted industries are provided as a guideline for identifying areas that may require enhanced due diligence. However, these lists are not exhaustive, and the Company reserves the right to conduct enhanced due diligence based on additional factors or circumstances as deemed necessary. The decision to conduct enhanced due diligence is at the Company’s sole discretion.
